离婚协议的性质

　 参照第31条，第11条第3款，离婚协议是双方当事人自愿离婚的意思表示以及对子女抚养、财产及债务处理等事项协商一致而达成的协议或者意见。离婚协议书则是离婚协议的书面形式，第11条第3款规定，离婚协议书应当载明双方当事人自愿离婚的意思表示以及对子女抚养、财产及债务处理等事项协商一致的意见。

　　根据第11条第1款第3项，;双方当事人共同签署的离婚协议书;是办理离婚登记的必备材料，因此，我国法上不承认口头离婚协议。对此，应与第10条第1款规定的民商事合同可以采书面形式、口头形式和其他形式相区别，此其一。其二，就书面形式而言，第11条规定;书面形式是指合同书、信件和数据电文等可以有形地表现所载内容的形式;。但对于离婚协议而言，书面形式应仅指离婚协议书，不应包括信件，更不应包括数据电文，特别是电子数据交换和电子邮件。这是因为离婚协议是登记离婚的必备法律文件，婚姻登记机关需要对此进行审查，而审查则须以离婚协议有形且符合形式和内容的要求为条件，而离婚协议书则完全符合这些要求，自然成为我国法上的选择。

　　从离婚协议的内容上看，包括三项主要内容，即自愿离婚、子女抚养、财产及债务处理等。其中自愿离婚即双方自愿解除婚姻关系；子女抚养涉及当事人一方行使抚养权，另一方支付抚养费，包括子女生活费、教育费、医疗费等费用。还包括未抚养子女一方探视权行使及保障等内容；财产及债务处理则主要包括夫妻关系存续期间的共同财产如何分割，共同债务如何清偿等。

　　根据上述三项主要内容上看，离婚协议的性质应是一种混合合同的性质，其中关于自愿离婚和子女抚养的内容属于夫妻人身关系的性质，而财产及债务处理则属于夫妻财产关系的性质。这两种关系在法律性质上均属平等主体之间的人身关系和财产关系。
